1. General

General business conditions of Senčila Bled d.o.o. (hereinafter: General Terms and Conditions) apply to all Products of the company. Company Products are all products offered by the company on its website (online store).

General conditions of the online store Senčila Bled d.o.o. are drawn up in accordance with the Consumer Protection Act (ZVPot).

The business conditions deal with the operation of the online store provider, the rights of the User/customer and the business relationship between the provider and the customer/user. The stated terms of business govern the sale of programs available in the online store. A purchase made through the online store is considered a purchase made in accordance with the regulations in force in the Republic of Slovenia.

The stated terms of business may be supplemented with new provisions at any time, so we suggest that the User read them before each purchase and print them out or save them on a suitable permanent data carrier. Each version of the Terms of Business is dated separately.

The submission of a valid order in the provider’s online store is considered the signing of the contract.

Due to the nature of business via the World Wide Web, the provider reserves the right to change the offer.

Orders placed will be processed during business hours Monday through Friday in the order in which orders are placed.

The online store and the presentation materials on it (picture materials, graphic and video elements, etc.) on the website are protected and may not be reproduced or used without the prior written permission of Senčila Bled d.o.o.

The provider assumes no responsibility and/or guarantees for errors on the online store (both in the image and text sections). The provider does not guarantee the operation of the websites and is not responsible for any negative consequences that may arise from errors or non-functioning of the online store, including but not limited to damage caused by viruses or other harmful programs.

All information, graphics and program elements in the broadest sense (texts, sketches, photos, video content, etc.) contained on the provider’s website are copyrighted work and are therefore already subject to copyright or other forms of protection as soon as they are created within the legally permitted framework. intellectual property.

All information related to the order will be available to the user before the purchase, including a summary of the order, where he can correct any errors, change the Products and their quantity, or other components of the purchase.

The general terms and conditions are published on the website in the form of a legal notice in the currently valid version. The provider may change these general terms and conditions at any time, and notice of any change will be published on the provider’s website. If the user continues to use the website after the general conditions have been changed, he is considered to have agreed to the new version of the general conditions.

2. Basic concepts

The provider is the company Senčila Bled d.o.o., with headquarters at Pot na Lisice 11, 4260 Bled, registration number: 1936964000, tax number: SI 26505444, which offers Products on its website.

The user is a natural or legal person who orders products.

All users and guests of the website https://sencila-bled.si/ have the right to purchase in the online store. No registration required for purchase.

If you are a citizen of other European Union countries and do not have a Slovenian address of residence, please contact us at one of our listed contacts to place an order.

A product is any product that you will find in our online store.

An order is an expression of the user’s will to use a certain product. You can submit an order using all the methods available in the online store. For help, you can always contact us at our listed contacts.

3. Nature of products

The provider’s products mainly cover the areas of blinds (external blinds, internal blinds, duet blinds, etc.), which we try to bring as close as possible to the user, in the way of a friendly user experience.

The products that we offer through our online store are part of the offer of our company Senčila Bled and you can always see them “physically” in our showrooms.

Product prices represent retail prices, include value added tax (VAT) and do not include shipping costs. Prices may change depending on the company’s current promotions and campaigns.

Due to the nature of online business, the range of products in the online store changes and is updated. Despite our best efforts and responsible business practices, mistakes can unfortunately occur.

In order to immediately eliminate any errors, please notify us immediately at one of our listed contacts.

In all our presentation materials (images, videos, pdfs, etc.) we try to show the colors of our products as accurately as possible. Due to performance and screen settings, color deviations from the actual physical form of the product are possible. In any case, you can also check this carefully before your purchase.

4. Rights and obligations of the Provider

The provider reserves the right to change the range of its products at any time and without prior notice, including the discontinuation of individual products. The provider has the right to cancel the product until the moment the user confirms the order and makes full payment for the ordered product, under the conditions specified in these General Terms and Conditions, as well as later.

The provider reserves the right to change the pricing policy for products. The provider may change the price of the product at any time and without giving reasons. The price change for an individual product does not affect users who placed an order before the price change.

The provider reserves the right to refuse the order, at its own discretion. The provider may reject the order in particular, but not exclusively, when:

• The user does not make payment for an individual product within the agreed term,

• The user makes a partial payment and, despite an additional request for payment, does not fulfill his obligation in full.

5. Methods of payment

Through the online store, the provider allows payment for its products in the following ways:

o payment according to the UPN form to the provider’s bank account,

o payment by payment (bank or credit) cards (MasterCard, Visa, American Express).

The security of personal data and payments is the domain of payment service providers. For everything else, the provider uses appropriate technical and organizational means to ensure the security and confidentiality of personal data and payment information.

The provider sends the customer an invoice for the ordered goods or services in the form of a PDF document to the e-mail address that the customer provides when placing the order on the provider’s website. At the customer’s request, the provider attaches a printed copy of the invoice to the ordered products, recorded under the notes when submitting the order.

It is the user’s duty to review all information and specifications of the order before placing the order. Objections made later regarding the irregularity of issued invoices are not relevant.

6. Prices

The prices displayed on the provider’s website may change without prior notice.

When doing business with consumers, the prices listed in the provider’s price list include VAT.

Prices are binding from the moment the provider sends the user an e-mail regarding order confirmation. In the event that the price information is incorrect or the prices change during the processing of the order, the user has the right to withdraw from the contract.

The prices indicated at the moment of placing the product in the shopping basket are valid, but not longer than 15 days, which is also the maximum time from the placing of the product in the basket until the confirmation of the order (hereinafter: “reserved price”).

Prices in the online store are in EUR and may change without prior notice.

The purchase contract between the provider and the buyer is concluded the moment the provider confirms the order or the user receives an electronic order confirmation. From this moment on, all prices and other conditions are binding and apply to the provider as well as to the User.

a. Purchase process

Ordering in the online store takes place in Slovenian, English and German online 24 hours a day and 7 days a week. The user can select and order products in the online store.

Order: After submitting the order, the User receives a notification by e-mail that the order has been accepted and at the same time receives the information for the transfer. The provider then reviews the order, checks the availability of the ordered product and confirms the order or rejects it with a reason.

7. Delivery and collection of ordered goods

The provider is expected to prepare the product for shipment within 3 working days, and no later than 8 days from the date of receipt of payment, and send it to the address specified by the user in the contact form specified when placing the order.

In the case of a longer delivery period, the user is informed about this and can also withdraw from the purchase with a refund. This is especially the case with the delivery of products that the provider does not have in stock in its own warehouse or is exclusively tied to the delivery by its supplier and the time in which this supplier can deliver the item to the provider, the latter is not responsible for any delay in delivery.

The provider is not liable for damage and at the same time does not violate its obligations under this contract, to the extent that it does not have the possibility to prevent delays in delivery or in case of force majeure in accordance with Article 153 of the Code of Obligations.

In the event that the user does not receive the ordered program within the agreed deadline, he must call on the provider to fulfill the obligations and set an additional deadline for fulfilling the obligations. If the provider does not make the delivery or fulfill the obligations even within the additional period, the user can withdraw from the concluded contract and request a refund of the amounts already paid for the purchase of the product.

The delivery of products ordered via the online store takes place via external delivery services and takes place throughout the EU.

The delivery cost is fully covered by the provider.

Personal collection

We also allow our customers to pick up products ordered through the online store in person. Simply mark this option in the shopping cart at the end of the purchase. You will be notified of the collection date via e-mail. Pick-up is possible during the salon’s working hours.

8. Complaints and guarantees

The products have a warranty as stated in the documentation you receive when you pick up the product.

Complaints, reclamations or warranty claims regarding the program must be communicated by the user in writing or via e-mail to the provider within 15 days of receiving the program or within the statutory period. It must state the findings regarding the product defect and the request for its elimination.

The guarantee is valid under the condition that (a) the products are properly stored or fed. If the conditions are not met, the warranty is void.

This article exclusively determines the scope of rights that the user has in the event of a technical defect in the product.

9. Right to withdraw from the contract

In accordance with the Consumer Protection Act, the user has the right to notify the provider within 14 days of receiving the goods that he withdraws from the contract, without having to give a reason for his decision. The deadline starts counting one day after the date of collection.

The user does not have the right to withdraw from the order in the cases specified in paragraph 5 of Article 43 of the Consumer Protection Act.

The user provides his personal information (personal name and contact information) together with the resignation statement. The provider returns the purchase price and all other payments no later than 14 days after receiving the notice of withdrawal, but the provider can withhold the refund until the returned program is received or until the User provides proof that he actually sent the product.

The only cost charged to the consumer in connection with withdrawal from the contract is the cost of returning the goods.

The user must return the received product undamaged and in the same quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of the user.

Payments will be refunded immediately or at the latest within 14 days of receiving the notice of withdrawal from the contract. The provider returns the received payments to the user/customer with the same means of payment as used by the buyer, unless the buyer explicitly requested the use of another means of payment. The program subject to a return must be unused, undamaged and in its original packaging.

The return of the received program to the provider within the contract withdrawal period is considered a notice of withdrawal from the contract.

10. Protection of personal data

In accordance with the regulation “EU 2016/679 Protection of individuals in the processing of personal data”, the provider undertakes to protect all personal data that will be used exclusively in the process of ordering products. The provider treats personal data as a business secret and does not pass them on to any unauthorized third parties.
